India’s Telecom Regulator Seeks Broader Powers Over Call Management Apps Like Truecaller

As spam calls continue to plague Indian mobile users—and legitimate calls increasingly get mislabeled as spam—the Telecom Regulatory Authority of India (TRAI) has taken a significant new step. The regulator has formally requested the Ministry of Electronics and Information Technology (MeitY) for expanded authority to oversee call management applications such as Truecaller. This move aims to address growing concerns about misidentification of genuine calls and the lack of a clear regulatory framework for such apps.

The Core Issue: Legitimate Calls Flagged as Spam

TRAI has pointed out that many valid calls originating from specific number series are being incorrectly marked as spam by popular call management apps. The primary numbers affected are those in the 140 series, used for telemarketing, and the 1600 series, designated for banking and government services. According to the regulator, this mislabeling causes users to miss important communications from banks, government agencies, and businesses, ultimately disrupting essential services.

TRAI’s Proposed Solution: Authorized Status Under IT Act

To tackle this problem, TRAI has written to MeitY requesting that numbers in the 140 and 1600 series be officially recognized as “Authorized Agencies” under the Information Technology Act. If this designation is granted, TRAI would gain the power to monitor and enforce rules on how call management apps treat these numbers. This would effectively create a regulatory oversight mechanism for apps like Truecaller, which currently operate largely without direct government supervision. The Ministry is currently reviewing the proposal in consultation with the Department of Telecommunications (DoT).

Not the First Directive: A History of Tension

This is not an isolated incident. Just a day before making this request, TRAI had already issued a directive to Truecaller and similar apps, instructing them to stop displaying spam warnings for calls from the 140 and 1600 number series. TRAI maintains that these numbers are exclusively reserved for legitimate commercial and governmental purposes, and therefore should not be subject to spam alerts.

In response, Truecaller’s CEO, Rishit Jhunjhunwala, stated that the company is complying with TRAI’s instructions and is in the process of whitelisting these numbers. However, he also raised questions about the regulator’s jurisdictional authority over call management platforms.

By the Numbers: The Scale of Missed Calls

The impact of this mislabeling is substantial. According to data from Truecaller, more than 51 million calls from the 140 and 1600 series go unanswered every single day. Additionally, users have manually blocked over 74 million calls from these series, suggesting widespread distrust—even for numbers that are meant to be legitimate.

Truecaller’s Counterargument: A Double-Edged Sword

Truecaller has expressed its own concerns about the proposed restrictions. The company argues that removing spam warnings from these number series could create opportunities for cybercriminals. If users become accustomed to trusting all calls from 140 and 1600 series numbers, fraudsters might exploit this trust by spoofing those numbers. Truecaller warns that this could erode user confidence and make it harder for people to identify genuine spam or fraudulent calls.

What Happens Next?

For now, the ball is in MeitY’s court. The Ministry is deliberating TRAI’s proposal alongside the Department of Telecommunications. If the proposal receives approval, it would mark the first time India establishes a clear regulatory framework specifically for call management applications like Truecaller. Such a framework could reshape not only how spam calls are identified but also significantly improve the user experience for banking, government, and business communications.
