Bar Council Approves Final-Year Law Students for AIBE, Exam to Be Held Twice a Year

The Bar Council of India (BCI) has informed the Supreme Court that it has finalized rules permitting final-year law students to sit for the All India Bar Examination (AIBE). In a significant development, the examination will now be conducted twice annually, offering greater flexibility to aspiring legal professionals.

AIBE serves as a mandatory qualifying test for law graduates seeking enrollment as practicing advocates with their respective State Bar Councils. Until now, only those who had completed their entire law degree could appear for this crucial examination.

Supreme Court Bench Takes Note of New Regulations

A bench comprising Justices Vikram Nath and Sandeep Mehta acknowledged the BCI’s submission while hearing a writ petition filed in 2024. The petition had sought directions to allow final-semester students to participate in the bar examination. With the BCI confirming the new rules, the court disposed of the petition.

During the proceedings, the council’s counsel stated, “AIBE will now be conducted twice a year, and students in their final semester of LLB will be permitted to take the examination after passing their final examinations.” The lawyer further confirmed that the BCI has formulated the Rules for 2026 to implement these changes.

Background of the Legal Battle

The journey toward this decision began in 2023 when the Supreme Court first directed the BCI to frame rules addressing the eligibility of final-year students for the bar examination. In a notable interim order passed in September 2024, the court had already allowed final-year students to appear for that year’s AIBE, recognizing that denying them this opportunity would result in a wasted year.

The court had observed that final-year LLB students could not be left in a state of uncertainty, emphasizing that barring them from the examination would cause significant professional setbacks and unnecessary delay in their careers.

Earlier Court Directives and Student Petitions

On February 10, 2023, the Supreme Court affirmed the BCI’s authority to conduct the AIBE. The court also accepted a suggestion from an amicus curiae to permit final-semester law students to appear for the examination, provided they submitted appropriate proof of eligibility.

The court took into consideration arguments advanced on behalf of nine LLB students, including Neelai Rai from Delhi University, and allowed them to sit for the examination scheduled on November 24, 2024. Advocates A. Velan and Navpreet Kaur represented these students in court.

Challenge to Restrictive Notification

The original petition challenged a BCI notification that barred final-year LLB students from appearing in the AIBE. The petitioners argued that such a restriction would severely hamper their professional growth and cause them to lose valuable time in advancing their legal careers.

Under the previous framework, law graduates were required to clear the AIBE before they could register as advocates. The restriction on final-year students meant that graduates had to wait until after completing their degrees, creating an unnecessary gap between completing their studies and entering professional practice.

What the New Rules Mean for Students

The revised regulations bring several advantages for law students:

  • Final-semester students can now plan their transition from academics to professional practice more smoothly
  • The twice-yearly schedule provides additional opportunities to clear the examination without long waiting periods
  • Students no longer face the risk of losing an entire academic year due to examination timing mismatches
  • The change aligns the examination cycle with academic calendars, reducing stress and uncertainty

This reform is expected to benefit thousands of law students across the country who previously had to navigate a cumbersome process that delayed their entry into the legal profession. By allowing final-year students to take the exam and increasing the frequency of AIBE, the BCI has addressed long-standing concerns about career progression for aspiring lawyers.

The decision reflects a progressive approach to legal education and professional certification, ensuring that talented graduates can begin their practice without unnecessary administrative hurdles. Law schools and students alike have welcomed this move as a practical solution to a persistent challenge in the legal education ecosystem.
