Supreme Court Adjourns Hearing on Delhi Private School Fee Regulation Challenge

The Supreme Court on Tuesday deferred until February 2 the hearing on a petition challenging the new legislation that governs fee structures in private schools across the national capital. The bench, comprising Justices P.S. Narasimha and Vijay Bishnoi, agreed to postpone the proceedings after Additional Solicitor General S.V. Raju, representing the Delhi government, informed the court that discussions with senior officials had already taken place and that one further meeting was required to resolve the outstanding issues.

Government Seeks More Time for Deliberations

The Delhi government’s counsel indicated that the administration needed additional time to work through the complexities of the matter before the court could proceed with substantive arguments. The bench accepted this request and scheduled the next hearing for the first week of February.

The case stems from a previous hearing on January 19, when the Supreme Court had questioned the Delhi government about the timing of the implementation of the Delhi School Education (Transparency of Fee Determination and Regulation) Act, 2025. The court had raised concerns that the Act was being brought into force after the academic year had already commenced, potentially creating confusion for schools and parents alike.

Fee Committees and Extended Deadlines

The court was hearing multiple petitions filed by associations representing private unaided schools, which have challenged both the Act itself and the subsequent rules framed under it. These petitions argue that the new regulatory framework imposes undue restrictions on how schools can determine and collect fees.

The Delhi government recently notified the Act, which includes comprehensive provisions covering permissible fee components, accounting practices, and curbs on additional charges. The law explicitly prohibits schools from collecting any amount exceeding the per-student fee approved under the legislation, and restricts the imposition of any extra levies beyond what is sanctioned.

In a related development, the High Court had earlier declined to stay a notification directing private schools in the capital to constitute fee regulation committees. However, it did extend the deadline for forming these committees from January 10 to January 20. The court also stipulated that the date by which school managements must submit their proposed fee structures to these committees should be moved from January 25 to February 5, providing schools with additional breathing room to comply with the new requirements.

The upcoming hearing on February 2 is expected to see further submissions from both the petitioners and the Delhi government, as the legal battle over school fee regulation in the capital continues to unfold. Schools and parents across Delhi are closely watching the proceedings, as the outcome will determine the framework within which private educational institutions can operate financially in the coming years.
