Supreme Court Seeks Response from CBSE and Centre Over Plea by Class 12 Students in West Asia

The Supreme Court on Wednesday issued notices to the central government and the Central Board of Secondary Education (CBSE) in response to a petition filed by Class 12 students studying in Gulf and West Asian nations. The students have sought a range of relief measures, citing disruptions to their 2026 board examination cycle caused by ongoing regional conflicts.

A bench comprising Justice K.V. Viswanathan and Justice Alok Aradhe heard the petition, which was filed under Article 32 of the Constitution, and requested responses from both the Centre and CBSE. The court also directed the petitioner to share a copy of the plea with the Solicitor General before the next hearing date.

Why Did Students Approach the Supreme Court?

The petition, filed through advocate Vineet Jindal, highlights the extraordinary difficulties faced by thousands of CBSE students enrolled in schools across Gulf Cooperation Council (GCC) countries and other West Asian regions. According to the plea, the regional instability has created conditions that have severely hampered the academic journey of these students.

Key concerns raised in the petition include:

  • Serious disruption to the examination process due to heightened regional tensions
  • Significant interruption of studies for a large number of students
  • Widespread mental stress and uncertainty affecting student well-being
  • Displacement and related hardships experienced by some students
  • A direct impact on the academic futures of those affected

The petitioners argue that the circumstances were entirely beyond their control, making it imperative for the court to step in and provide necessary relief.

Relief Measures Sought by the Students

The petition outlines a series of specific requests aimed at mitigating the academic damage caused by the conflict. These demands include:

  • A one-time grant of grace marks or additional scores
  • Arrangement of special re-examinations for affected students
  • Conducting dedicated improvement examinations
  • Allowing students to choose any number of subjects for these exams
  • Permitting students to retain the better of the two results obtained
  • Ensuring that no student loses an entire academic year

Concerns Over the Evaluation Process

The petitioners have also challenged the CBSE evaluation scheme that was released on March 27. They argue that the existing assessment framework does not adequately account for the exceptional circumstances faced by these students. The plea contends that:

  • The current evaluation system fails to reflect the true academic capabilities of the affected students
  • Results based on this system could adversely impact higher education admission opportunities
  • The assessment process must be fair, transparent, and free from any form of discrimination

Requests for Admission-Related Concessions

Beyond examination-related relief, the petition also seeks adjustments to various admission schemes that apply to Indian students residing abroad. Specific demands include:

  • Under the DASA (Direct Admission of Students Abroad) scheme, reducing the minimum score requirement from 75 percent to 60 percent for the 2026-27 academic session
  • Extending special admission-related concessions under the CIWG (Children of Indian Workers in Gulf) category to students whose parents are employed in Gulf nations

Demand for Special Counselling and Provisional Admissions

The petition further calls for administrative measures to ensure that affected students are not left behind in the admission cycle. These include:

  • Directing universities and educational institutions not to reject applications from students impacted by the conflict
  • Granting provisional admissions where necessary, pending revised results
  • Opening a separate counselling window after special examinations and revised results are announced
  • Taking all possible steps to ensure that no student loses a full academic year

Prior Attempts to Seek Resolution

The petition notes that students, parents, and community organisations had previously made multiple representations to both CBSE and the Ministry of Education. Despite these efforts, no comprehensive relief mechanism was put in place for the affected students. The war-like conditions and accompanying psychological pressure have taken a toll on the entire examination process, the petitioners state.

The students maintain that thousands of academic futures now hang in the balance due to circumstances completely outside their control. This compelling situation has driven them to seek urgent intervention from the Supreme Court, hoping for a resolution that will safeguard their educational prospects and prevent the loss of a crucial academic year.
